HOA fees

Our small HOA decided to hire an attorney to argue with city over planned water tower adjacent to our subdiv. We think all owners sh/pay portion of his fee. Two owners refuse, saying the covenants only grant authority to collect $ for road maintenance. Can we file lien on their properties for their unpaid portion of lawyer's fees?

It entirely depends on what the covenants say. Also relevant, but on a secondary level, would be the powers granted by the documents that set up your homeowners association.
