Legal Question in Real Estate Law in Indiana

My mom gave my husband and I $110,000 5 1/2 years ago when she moved in with us. She is now wanting to move out of our home and has demanded her money back At the time she gave this money to us no papers were signed, etc, we all thought she would live with us for the rest of her life. There was NO converstaion at the time saying we would have to return this money to her if she decided to move out. We have offered her $40,000 but she has declined it saying she wants at least $90,000 back. We are not able to finance more than the extra $40,000 on top of our mortgage. What are are rights regarding having to repay her. She has told us she would be taking us to court if her money is not returned. Her name is not on our house or anything else we have

Thank you in advance

What a mess? What has been the cost to feed her these last years. Also, what is the cost

for a rental of a room in your area. You could probably legitimately state that these are credits.

You really should see an attorney-too much at stake to not do so.
