Legal Question in Real Estate Law in Indiana

My name is Sarah. In August of 2009 my fiance and I purchased our first home together in both of our names. 5 months later we have split. The question I have is what legal action can I take or file to maintain the ownership of the house. We both want the house and can not come to an agreement between each other. The house is in both of our names, financially he does not have enough coming in monthly in income to afford the household and personal expenses right now. I on the other hand do have enough income coming into afford the household expenses and current personal expenses. We do not want to go to court and have them order the home to be sold so what can I do?

Agree to an auction. Either of you can buy it at the auction, as well as a third party. Beyond coming to an agreement between the two of you, and having the court order a sale, there are NO other options.
