Legal Question in Wills and Trusts in Indiana

Estate Will

My father is trying to add his name to my step-mother's will. It has been a couple months since she has died. Can he legally do that?

Re: Estate Will

Your father cannot add his name to his deceased wife's will, but he would be entitled to receive the "family allowance" and other assets if he desires to assert his claim as surviving spouse. He should confer with a lawyer experienced in probate law. Good luck.
