If my mothers will stated to divide assets equally amongst three sons,(only assets house,about 120,000.oo & contents). Is there a need to put in probate? House deed needs to be transferred from my fathers name(deceased 10 years)

If the home is in your father's name only, then you must open a decedent's estate for both your father and your mother. If the home was in joint tenancy of some sort with your father and your mother together, then you can probably get by with only one estate. In any event, you will certainly need to open a probate estate for your mother in order to obtain good title to the house. Good luck.
