Joint owner on deceased Mother's savings acct.

My mother recently passed away with no assets other than about 1400.00 she had in her savings account. I am named as a joint owner on this account. It has been frozen for 45 days along with her checking account. She had a credit card through this credit union with a balance of about the same amount. My question is this... can they legally attach this savings account for what was owed on the credit card? There will be a balance owed on the funeral bill and none of us is financially able to pay it. Thank you for any advice.

The short answer is Yes. The credit union probably has a cross-oollateralization clause on its credit card, and is entitled to keep the balance. If there is no cross-collateralization clause, then the credit union must release the money to you. Make a written demand for an explanation of the credit union's behavior.
