Is it legal to host a website that is a "network stresser" which basically simulates a DDOS attack to test YOUR OWN server performance/firewall under normal and under excessive loads.

Why not? If it's a test of your own system nobody else will be affected-on the other hand, can you be absolutely sure it won't wander off the reservation, so to speak?
