Legal Question in Employment Law in Iowa

I was originally working for my employer as a temp and then was hired on after seven months or so. My employer let me know recently that they have been over paying for the entire time I have been employed with them Aug. 2010. I have direct deposit, pay vouchers are only available to me online, and the pay was not much different than what I had been paid as a temp employee. I knew the check would also have a differential included, because I worked what was called a "swing shift," and so I was to be compensated for those hours I worked. Honestly I probably wasn't looking as closely at the pay voucher as I should I have that I didn't notice that they were paying me a higher hourly rate than what I should have been paid. The employer is putting the blame on me. I do take part of the blame that I trusted them too much, however they paid it out to me. Why did it take till December of 2010 for them to notice! This has put a lot of stress on me and my fiance and changed our whole budget now that they are saying I need to pay them back almost three thousand dollars. I know for a fact that there have been incidents where the company has overpaid other employees and not asked for the money back. Why are they making me? Is that not discrimination of a kind?

If they overpaid you, it's not your money. It's that simple. Give it back and get on with your life.
