Legal Question in Real Estate Law in Iowa

We bought a house from the sellers. the sellers had put some ernest money down on a house elsewhere. We told the sellers we were not pre approved yet but they put the ernest money down anyway. They lost out on their ernest money because we had to go to a different bank for financing. We finally got the financing. Now the seller is trying to sue us for their lost ernest money. Can they do that?

Can they sue you? Yes, absolutely. Will they win? It depends on what your purchase agreement with them says. It is not clear from your question if you have closed on your purchase or not. If not, you need to hire a real estate attorney to represent you. If you have already closed, you should have a real estate attorney review your purchase agreement and advise you.
