Legal Question in Family Law in Kansas

When I left my childerns dad five years ago we both agreed that the childern would live wiith me. so they have for five year. the problem is I have no legal papers that says I have cousdy up until now it has been a verble agreement between us. he says that without any paperwork he can keep them and not give them back. he also has told me ther would be nothing i could do about it. do I have to have a lawyer to file for cousdy and how much would it cost me do I have the right to keep him from seeing the kid untill i get the pappers to have cousdy

Because there are no child custody orders from the court, both parents have equal rights to the children. Unfortunately, that can lead to arguments about parenting time. You should consult an experienced family law attorney about starting a paternity case. Even though actual paternity may not be an issue, a paternity case is still the legal way to obtain custody orders and a parenting plan.
