Legal Question in Civil Litigation in Kansas

Storing personal items

A friend that lived with me for a short time, moved out July 1, 2008. She couldnt afford a UHaul to move her furniture at the time, so she left it in my garage. In August, I called her to find out when she was going to be able to come get her stuff, I got no direct answer from her. Now in October, I have called her 3 weekends in a row, because I need her stuff out of my garage. She wont answer her phone or call me back, Ive left voice mails each time. I want to tell her if she doesnt come get her stuff, Im going to donate it to the Salvation Army. Can I legally do that? Its been almost 4 months.

Re: Storing personal items

You need to write aletter or email to your friend at an address that you know or reasonably believe will get to her. IN that letter tell her that you demand she retrieve her belongings within 72 hrs. Keep a copy of this letter. If your friend does not get her stuff out, (or make other arrangments with you), you can probably use or get rid of it. That is IF yo uhad nto arragement with yoru friend that says you will hold the stuff for her. You are making these calls and sending tyhe letter to make sure that she does not think that you have agreed to hold her stuff for her for an extended period.

Good Luck
