Legal Question in Consumer Law in Kentucky

Unauthorized Credit Card Billing Question

I purchased business cards online last month. This company provided my credit card info to an affiliate without my knowledge. The 2nd company used my info to sign me up for a long-distance service I didn't order and billed my credit card $55. The 2nd company keeps promising to return my money but 3 promised repayment dates have passed and still I have nothing. I reported them to the BB for fraud, but what else can I do? Can I sue for this small sum? Can I recover court costs, ect...? What about damages? Would I need to file in KY (my state) or in VA (their state)?

Re: Unauthorized Credit Card Billing Question

I'm sure that you aren't the only person this has been done to. It might be a very nice sized class-action suit against both companies. You could recover attorney fees, costs, and maybe punitive damages. It sounds like this is an intentional fraud issue. Contact the Kentucky Attorney General, the Va. Attorney General regarding criminal prosecution. Contact your credit card company to contest the charge and have the money placed back in your account. You can file in Kentucky if they have offices or operate in the state of Kentucky. Otherwise, you'll need to file where the company operates.
