Legal Question in Criminal Law in Kentucky
Dismissed Citation?
I resently was given a citation for illegal litering in Kentucky, I threw a tree branch from my yard into some thick woods. After the officer wrote the citation and made me ''sweat for awhile'' he then stated ''Dont worry about a lawyer I will not be at the hearing.'' Does this mean when I go to court will it automatically be dismissed if he is not present? Do I still have to pat court costs?? Thanks

Re: Dismissed Citation?
If in fact he is not there, the prosecutor may try to get you to plead to the charge anyway, or make you come back a second time bfore it is dismissed. If it is dismissed, then you would not have to pay court costs. It sounds strange that the officer would say he would not be there and still write you a citation.
