Can Kentucky law charge a person with 1st degree assault and robbery at the same time. My son recieved 35 years for charges of 3rd degree assault, 1st degree assault, robbery and theft $300. He has spent seven of those years so far at KSP. Someone has told him that they cannot charge you with assault and robbery at the same time which would take his years down to 10 and he would be able to get out soon. Is this possible.

Charging

There is nothing to prevent charging both assault and robbery in the same indictment. Depending on the underlying facts, there could be some effect for "double charging" at the time of sentencing, but even that is not particularly likely.
