Legal Question in Criminal Law in Kentucky

wrongful conviction

My son just received 15 yrs for possession of a firearm/PFO2. The police had no witnesses, nor did they have any evidence proving he had ownership. The D. A. had my son's rag and the gun as the only evidence but never said my son used it to wipe prints off the gun. (no prints were found) Wouldn't that be misleading/prejudicing the Jury?

Re: wrongful conviction

It is hard to make a judgment about a criminal conviction based on such a short report. That said, there are (unfortunately) a lot of people in prison who were not properly proven guilty. To get a legitimate answer, you will have to have someone look at the whole case. Start by talking with your son's lawyer.

If you want a second opinion, get someone experienced in criminal law to look at the record of the case.

Good Luck!
