Liability

If I go to a party, and the host serves me alcohol in a mixed drink and I am not aware of it, then he lets me leave and I wreck and hit someone walking across the street and kill him, can the person holding the party be held accountable if I have no assets or insurance but they do?

Interesting question. Certainly, if you are under 21, the person serving you alcohol can be held liable for civil damages; perhaps even with criminal liability.

If you are above legal drinking age, it is a bit more complicated. While it may be criminal to slip a person alcohol or drugs without that person's knowledge, many states have laws which would make both parties civilly and criminally liable. Adults are held responsible for knowing whether or not they are too intoxicated to operate a motor vehicle, whether they ingested alcohol or drugs voluntarily or not.
