Legal Question in Family Law in Kentucky

Child Support And Custody

I am an unwed father who has a 5 mnth old baby. The birth was totally unplanned, but that doesn't matter because I love him dearly. His mother and are not getting along. She has made several threats of taking him away from me. Which I believe she is just using to scare me into staying with her. Right now I am the only financial support for him...she doesn't have a job and didn't have one about 6 mnths before he was even born. I guess my question is What am I in store for? I'm not the richest man in the world, but I want to have as much contact with my son as possible, as well as finacially support him. How much money am I lookin at here. Child Support? Lawyer costs? I know this is a loaded question, and every situation is different, but I could really use some advice

Re: Child Support And Custody

you need to file a Paternity action to establish your rights and then you will most likely be ordered to pay child support. Child support is set by the child support guidelines in ky and is based on income. you can also ask for a visitation schedule to be entered.

You are right, each situation is different. You may actually be the parent who is named residential parent if the facts support it. Mother's and fathers are supposed to be seen as equal in determining the best interest of a child (individual judges vary) and what sways one way or another are a set of factors set forth in statute.

The best thing for you to do is consutl with a family law practitioner and go over your specific situation. Some do a consult for free while others charge $150 to $200 for an initial consult.

Believe me, even if you pay for a consult, it will be money well spent because you are describing a situation where decisions made now will impact the next 20 or so years of your life.
