Legal Question in Family Law in Kentucky

Child Support/Visitation Rights

A person told me the other day that if the DAD didn't pay child support he would not be allowed to see his children.....is this correct for Kentucky?

Re: Child Support/Visitation Rights

No, this is not true. I cannot answer for what every judge will do, but the requirment for restricting visitation is that the visits seriously endanger the child. Child support totally separate.

However, if you get so far behind in paying child support that you get thrown in the pokey, a judge might decide that the child visiting his dad in jail seriously endangers that child.

Re: Child Support/Visitation Rights

You absolutely cannot, in the state of Kentucky, refuse to allow a non-custodial parent visitation with his or her child simply because child support has not been paid. There are other options available to enforce an order for child support. By refusing visitation, you jeopardize your own situation. I suggest you talk to an attorney about your legal options.
