Legal Question in Employment Law in Kentucky

Medical Release

I was injured in an auto accident and my FMLA has expired. My employer wants me to sign a medical release so that they can have access to my medical records. The medical release requests not only information about my physical injuries, but is also requesting release of information related to psychiatric care and treatment, treatment for emotional problem and treatment for substance abuse. In fact, the release only mentions physical condition once and all the the above several times. This release mentions nothing about medical records as they relate to the accident, but seems like a blanket release asking for all my medical records. I really don't wish to sign to release as I don't think my medical records not related to the accident, which is why I am currently unable to work, is any of my employers business. Should I sign this medical release?

Re: Medical Release

That's a difficult question to answer. Have you applied for short term/long term disability through your employer or their insurer? If so, the contract of insurance may require you to sign a blanket release. If this is not for disability coverage, what does the employer want or need the information for? They have no general right to see these documents and records, so in truth, i need more information before i can give you an educated response. Good luck.
