Legal Question in Landlord & Tenant Law in Kentucky

I am a volunteer officer of a small 501c3 organization. The organization is contemplating signing a lease for office space. Am I in any way liable for contractual agreements if the organization defaults?

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. In most situations, you would sign the lease only in your capacity as officer of the 501c3 organization; not in your individual capacity.

A great deal depends upon the exact wording of the lease and its signature line. Poorly worded or ambiguous documents may result in your inadvertently assuming personal liability for payment on the lease.

It would be wise for you to show the document to an attorney before you sign it. Many Louisville lawyers would be happy to represent a 501c3 pro bono, without charging a fee.

You should not take any action, based upon my advice, without consulting an attorney and explaining all the facts to him. You are best advised to seek the services of a competent Kentucky attorney.
