Legal Question in Wills and Trusts in Kentucky

My father just passed away and his wife is in the nursing home with doubts she will ever go home. She has a house and car that was left to her in survivorship. Is it true that we will have to sell the home because now her SS checks will automatically go to the nursing home until the house is sold? Would we not be able to use some of her SS money each month to maintain the property until we are able to sell it (ie, property taxes, insurance, utilities)?

So sorry about your father. Concerning your father's wife, what happens now since she is in a long term care facility can be very complicated. If you are the person appointed under her Power of Attorney (or her legally appointed guardian) then you may want to seek the assistance of an elder law attorney. I suggest Bernard Faller (www.kyelderlaw.com) but there are many others in the Louisville area that do a great job. All the best.
