If any items were purchased during the marriage, the property is community property and her heirs will own half. A succession will have to be filed first. If the property was his separate property it is still his property. If it is removed without his permission it would be considered theft.

Her succession should be opened giving ownership to the deceased person's heirs. If the assets are worth more than the debts, or if the killer has property or money anywhere, a suit for wrongful death should be filed against him seizing all of his assets, including any interest he has in the property obtained during his marriage to the deceased person. He needs a lawyer who knows personal injury, succession law and domestic law.
