Legal Question in Criminal Law in Louisiana

Expunging a record

My 20 yr old college son is serving 2 yr probation on 2 charges of poss. of marijuana w/the intent to sell. He was told the record would be expunged once probation & college were completed. Is this automatic or will he have to file something else? Also, will he have to report this on job applications after it's expunged?

more than likely your son plead as a Youthful Offender. As such, he does not have to report that he has a felony conviction. Before the Alabama legislature now is a bill for expungement. That will not work in this case. His file is sealed as a youthful offender.

The e-mailed question stated you were asking about Louisiana Law. I assume he pled under 894 of the Criminal Code. If so, he will need to file for the matter to be dismissed. He would not have to tell anyone he was convicted because the result is a dismissal.
