Legal Question in Criminal Law in Louisiana

filing suit against the person responsible for my childs fathers death.

My 11 yr old daughter lost her father yesterday due to the carelessness of another person. Her father (my ex_) was on a motorcycle and the other person in a car. The person driving the car was looking elsewhere when he turned into the path of the (motorcycle).

We have been told he may not even be charged!!!! I want to know if I can file a lawsuit on behalf of my daughter the loss of her father and the monetary help and health ins. coverage she would have had from him?

Also the pain and suffering this has caused us both.

YES, YES, YES, YOU MOST CERTAINLY HAVE THE RIGHT TO SUE......Many people think that someone must be charged with a violation, or be issued a ticket, in order to be responsible for injuries or death resulting from their conduct. Remember, a law enforcement officer gets to an accident scene after the accident and issues citations from what he is told and what he observes. I have handled many motorcycle accidents and can tell you that you have a cause of action on behalf of your daughter. If you wish, call me and I will be happy to discuss your options.
