Legal Question in DUI Law in Louisiana

Bail out or stay in?

My friend has been charged with third offense DWI and driving under suspension. He is currently in jail. He has two other charges pending that may be reduced if he is out of prison in time to appear in court. Is it a good idea to go ahead and bail him out of jail so he can appear in court for his other charges and then simply let the courts decide his sentence and let him serve it? Or should I let him serve his time right now while he is already in prison?

Without knowing a bunch of more facts and circumstances, I would not venture a guess at what you should do. As a personal observation, it seems your friend has some problems he needs to address.

Well, it's really up to you. DWI 3rd has a minimum sentence. The other charges aren't going to go anywhere while he's in jail, but I suggest he contact the other court to let them know where he is. He may be able to get everything taken care of with concurrent sentences running with the DWI. However, I say that without knowing what the other charges are, so my advice may change if I knew what the other charges were.
