currently legally seperated for 10 months now , my ex husband & I have been having sex - does this make seperaton / divorce null ?

Since there is no such thing as a legal separation, what do you mean by legally separated? Just having sex without making a commitment to make the marriage work again does not affect anything. If you actually have a legal separation, it is too late to use that for a divorce.
