Using FMLA for care of spouse

If someone needed to take an leave of absence to care for a loved one (spouse) and was working under a CBA, wouldn't they be able to use sick leave and vacation.

It states in the CBA,''AS provided in the FMLA, regular accrued sick time and vacation must be taken during a FMLA leave of absence.''

You need to talk to your union representative about what the terms of the CBA mean. As a general rule under the FMLA, sick and vacation time can be run concurrently with FMLA leave time. It appears under the terms of the CBA as if that is the intention of the parties, but you would need to talk to your union representative about it.
