my husband has a wrongful death lawsuit, he was offered a settlement and wants to accept, his attorney is insisting that it be brought to trial. Is this legal? And can he circumvent his attorney and accept the settlement?

He should immediately meet with the attorney for a reason why and work this out. This sounds strange. If he is the plaintiff the case is his property.
