Legal Question in Intellectual Property in Louisiana

Trademarked Products in Photos

I am designing the menu and a website for a restaurant in Baton Rouge, LA. I had a photographer take shots of each dish, and many of the photos contained either a bottle of Tobasco or a bag of Lays potatoe chips. Is it illegal in any way for me to use these photos in the design of the menu or website? Will I need to obtain permissions from those companies to include their products in our photos? I would rather not have to retake the photos if possible. Thankyou for your time.

I very much doubt that they would mind the inclusion of their products. You could go through the formality of requesting permission just to be completely polite and safe.
