Legal Question in Personal Injury in Louisiana

False Imprisonment

I was arrested for an out of warrant. I was arrested at my parents house while attending college and working. My family was awaken at gun point by what I believed to be swat team. That evening, while in jail, I was featured on a nationally televised tv show as wanted by the law. I was not aware of any warrant or any charges against me. I was in jail for one month. Finally at the extradition trial it was revealed that they had my father's name on the warrant (I am a junior). The judge dismissed the case until a new warrant was issued with the correct name on it. A new warrant was never issued. This occurred in 1999. Statute of limitations for filing a lawsuit is probably passed. Can I do anything about this 9 years after the incident. A lawsuit against the tv station for still airing my situation even though I was already arrested? Defamation of character? I am finally in a situation where I can afford an attorney and I am worried that I have waited too long to file a lawsuit.

Re: False Imprisonment

You have waited too long to file under State law in my opinion. Defamation or libel must be brought within 1 year of the publication. However, there may be a constitutional rights violation that may not have prescribed. I simply do not know personally, although I feel that you probably have no right to sue anywhere. I am sure another attorney may have a different opinion.
