Legal Question in Personal Injury in Louisiana

third party lawsuit???

i worked for the state and hurt my back while building a credit union.i was told to move an a.t.m that i shouldn't have been moving.had back surgery because of it.i am on workmans comp.can i sue the credit union as third party? i am getting w/c from the state.and the credit union is a different inity

You have not expressly stated facts indicating that you are in Louisiana, and many people use the wrong categories. If you are in Louisiana, I would respond, generally, that third party liability is not the norm, e.g., it cannot be used simply because you are not satisfied with the benefits of workmen's compensation. A third-party tortfeasor must have done something (or possibility failed to do something he/she/it was obligated to do) which was constitutes negligence. Your facts lack sufficient detail for someone to give as knowing and intelligent a response as you should receive.

To that end, I would advise you that your best option is to speak with an attorney who practices worker's comp and personal injury in the jurisdiction/venue where the suit would be filed.
