Legal Question in Personal Injury in Louisiana
personal injury lawsuit
My friend was shot by a man on that mans (shooter) property and it was done maliciously and while the shooter was very intoxicated.
Does my friend have grounds for a lawsuit and can he recover damages from the homeowner 's ( the shooter) insurance company? My friend was very seriously hurt and is disabled from such. The incident happened 6 months ago and we think he needs legal representation. Thank you.

Contact a lawyer immediately. He might have a case but a capable lawyer can analyze all the facts and guide him in the right direction.

Based on the facts you present here, yes; he does have a case. Yet time is running out. He has only one year within which to file a suit to interrupt the running of the statute of limitations; that is, one year from the date that the shooting happened; and after that, he can forget it, if he does not file his suit for damages within that one year period following the incident which gives rise to the cause of action for damages. And most lawyers do not like to take a case at the last minute. An old lawyer once told me years ago not to ever take a tort damage case unless I had at least one month to get a suit filed; and, frankly, that is really too late for a lawyer to jump in and to risk his estate, and maybe even law license by jumping into a tort damage case at the last minute. Advise your firend to immeditely contact an attorney who handles personal injury cases, today or tomorrow....not to wait any longer!
