Legal Question in Personal Injury in Louisiana

Slander

A good friend of mine got a check from someone who owed her money from her 401K. When she got the check the person who had written the check had written thief!!! in the memo section. My friend was very upset and went to a different branch than the one she usually uses to cash this check. She got a copy of it notarized first. Does she have a case against the person who wrote the check? My friend's husband had stole alot of money from this person and as part of a consent judgement she got his 401K. They had also tried to sue her but were unable to as she had nothing to do with the theft.

If the question is, "Someone wrote 'thief' in the memo section of a check. Does the payee have a defamation claim against the maker (checkwriter)?"

My answer is, that I cannot give an ironclad answer. In the most generous sense, yes, but you should be able to find more money in your sofa cushions.
