Legal Question in Real Estate Law in Louisiana

failure to perform

My husband signed a purchase agreement with a couple to buy a lot that we owned. We live in a community property state and I refused to sign to sell this lot. They are now suing for failure to perform. Do we have a good enough legal reason to breach this contract and if not, what could the damages be??

The other party may have a claim against your husband, but I doubt that they have relied to their detriment on the contract. You should get an attorney who will look out for your interests because your husband isn't, if you really own part of this immovable property.

If the lot is community, then your signature is needed and the contract is not binding against you. Of course if they want 1/2 interest in the lot, then that is all your husband could sell. My answer may change if the facts are not exactly as you said.
