Partition Action

Please explain how a Partition Action works, particularily in a case where all parties do not agree.

In a partition action a party sues his co-owners to sell or divide the immoveable property. You ask the court to either sell the property at public auction or split the property in equal shares (ex. vacant land). I have only used a partition action when the parties do not agree. If there is an agreement there is nothing to sue over. However, if the partition is community property between spouses/former spouse, it is a partition of community property.
