Seller failure to keep Agreement to Purchase

We purchased a house 01/23/2006. There was a stipulation that the flashing sround the exterior part of the chimney be repaired/replaced. This was never completed and there are additional damages caused by sitting rain water. What is the statue of limitations for this situation? We have only recently had heavy rains so the damage was not evident until recently.

If the stipulation was in writing, then you probably have 10 years. But a defect discovered after the sale gives you a year after the discovery unless you knew or should have known about it. This is very basic and could change according to how the facts develope.
