Legal Question in Consumer Law in Maine

Car damage

My car was hit by a shopping cart in the Home Depot parking lot. It made a huge dent in a door of my car. Estimate for the damage was appraised at $1,200.00. When Home Depot was contact about this, their response was that the accident happend in the parking and since they don't own the parking lot, they are not responsible fot the damage done to my car. However, the car was damage by a shopping cart that is own by the Home Depot store.

I would a legal advise to what I should do and if there is anything that can be done about this.

Why would Home Depot be liable? Did an employee lose control or ram into you?

Did the wind blow it?

Talk to your insurance agent + make claim in small claims if not covered.
