The other woman

My husband was Divorced about 9 years or better and while he was married he co-signed for a truck that his wife ended up not making the payments and it was repoed but the company that repo it didnt enform my husband of the information so the truck got sold and he now owes the bank 4000.00. Please help

For starters, the divorce allocation of the truck and its payments to the ex-wife are not binding on the bank, the bank originally agreed to make the loan to them both and the bank still has the right to go after him if the debt went bad. If nothing else, he will have to settle up with the bank on the best terms he can and then file a post-divorce action against her to recover what he had to pay.

However, it is also important to find out when the payments stopped, the truck was reposessed, etc. Maine has a 6 year statute of limitatiopns on lawsuits. This is not from when the loan started or the divorce was granted, but when the loan went into default. It may be that the debt is not legally collectable anymore so that should be looked into before agreeing to pay anything to the bank.
