Legal Question in Criminal Law in Maine

Retracting My Guilty Plea

I was arrested for violating a PFA order. I know ignorance is not any excuse. However, a few days after being hospitalized for a mental illness and I made a mistake in going to my home to retrieve items, not thinking that the PFA order also excluded me from being on my property. Even though I did not contact my ex-wife in anyway, she saw me outside and calls the police and for the first time in my life I was arrested. 5 month's later, thinking I was doing this right thing, pled guilty on the DA's recommendation of no jail time and for me to take 6 month's probation with conditions of a psychological review. I did not have an attorney for I thought it would cost money, and I had none.

Currently serving my probation, I now realize that I did not have a capacity to make the right choices, during both the original incident and the entering of my plea. It was devastating to loose my son, wife and home all at once and lead to my ''breakdown''. Is there anything I can do to change my guilty plea?

Re: Retracting My Guilty Plea

Contact an attorney. It might be possible to withdraw your guilty plea because you were unable to knowingly and intelligently waive your rights.
