Legal Question in Medical Malpractice in Maine

medical malpractice

i had a routine c-section and during the procedure my pelvis was broken.the hospital did numerous tests to see if it was because of bone problems...they showed none...due to the fact that this happened in the hospital is the doctor or hospital itself responsible?is this considered malpractice...i went into the hospital fine and came out broken.

Re: medical malpractice

In most states the doctrine of res ipsa loquitor applies. This latin expression means "the thing speaks for itself". I think it likely that an appropriate OB expert woulld agree that pelvic facture is not a result of a properly performed csection. In fact it sounds like you have been given no explanation. You should consult a lawyer with experience in handling medical malpractice claims.
