Rented home with no disclosure of radon, is this a breech of contract on landlords part?

Although the law regarding radon testing was signed by Governor Baldacci in 2009, it gives owners until the year 2012 to have initial radon testing done.

However, if the landlord has already had radon testing done, he is obligated to provide written notice to a tenant or potential tenant regarding the presence of radon in the building, including the date and results of the most recent test conducted, and the risk associated with radon.
