Legal Question in Criminal Law in Maryland

2nd degree assualt

Me and my fiancee were vacationing in Ocean City,Md. with friends. I had to much to drink with the guys and got into an arguement with my fiancee in the hotel lobby. I do not remember what happened but she said I pushed her. The hotel desk lady seen this and called the police and another hotel guest held me on a lobby couch. The police came and arrested me and I spent the night in jail. The police told my fiancee that he had 3 statements that said I hit her which she totally denies. The policeman she says would not take her statement for what she was saying but she stuck to what happennd. The policeman wanted her to say something terrible had happened and was trying to coach her. I am 37 and have a crystal clean record and love her very much. We have been together for 11 years and have a 10 year old daughter. Also I take the medication Celexa for depression and I normally do not drink but I think the combination caused this. What do you think my outcome will be?

It's too early to say, but you can expect the State's Attorney to do anything they can to prosecute you. If your fiancee says you did not hit her, then you should not be convicted. The police often go to far and coerce an alleged victim because they think that she is hiding something. You should get a lawyer ASAP and provide more details.

2nd degree assualt

The State does not need your fiancee's testimony if they have other witnesses. No one should make any more statements to the police. Consult with a criminal trial lawyer.
