Is a current offense in one state considered a probation violation in another?

My son lives with me Maryland. He is being charged with Possession of a controlled substance. He was passing through a high drug trafficking area and got caught up in a sweep. Police did not find drugs on him, but found them nearby in the alleyway where he was walking. He is currently serving the last year of a 5 year Juvenile Offender probation from NYC. Maryland has offered him a PBJ if he pleads guilty. He has no eyewitnesses to substantiate his innocence. If he takes the PBJ, will that be considered a violation of his NYC probation?

If your son's active probation has not expired his plea of guilty to CDS will most likely violate his current probation. He has nothing to lose by challenging the government's allegations. In fact, he may not even qualify for PBJ if he still on probation from the first. Does he have a lawyer in either case? Call if you need further info. Joe Trevino 1800-924-6217
