Legal Question in Family Law in Maryland

Hi Alex, My husband self represented himself, in a case to have immediate custody of his children. The judge gave him emergency custody until the hearing yesterday, he did the self representation thing again and failed miserably. The children testified in court that their mother was abusing them physical and emotionally, they gave some detailed accounts. My thought they did not give enough accounts to persuade the judge. Ultimately the judge gave the children back to their mother until further investigation with Child Protective Services. The children 15 and 13 said their mother told them to �lie in court and that they should not put her in trouble�. Also she told them �I am your mother you should not go against me��.What can my husband do help the children? Now they are really afraid to talk. Could the judge have let them talk in private? I feel like the cracked under pressure a was scared to talk.

The short answer is that the Judge could have done a number of things, but ultimately did what he or she did based on all of the facts presented. I would really need all of the facts before giving you sound advice. There is much more to this case than what a short synapsis will allow you to tell. What the children may need more than anything is some type of counseling.
