Legal Question in Family Law in Maryland

Divorce

I want to file for divorce. I have printed all the forms off the clerk of courts web site. The statement said I may need an attorney if my husband cannot be located to be served with papers. He is hiding in WV and even child support enforcement cannolt locate him. I already have an order for child support so I just want the final divorce. Can I do this myself? I cannot afford to hire an attorney again.

Re: Divorce

If there is no marital property, which includes any retirement accounts or pension plans he (or you) may have, and you have been separated for at least 2 years, you can proceed without an attorney. You will have to publish a newspaper notice of the filing in order to "serve" him with the papers. You will need to file a motion to get court permission to do this. Perhaps you have found the form for this on the website. You should check with the circuit court in your county to see if they have a "pro se (pronounced "say") program which offers assistance to persons like yourself.
