Exceptional Circumstances

Can you tell me what constitutes exceptional circumstances in third party custody cases? I was sole caretaker to the exclusion of either parent from birth to present; totally supported child; am psychological parent: encouraged relationship with natural parents; had knowledge and consent of both parents to care for child; custody evaluation and best interest attorney said child should remain in my care

There is no definitive list of exceptional circumstances. Each case is determined on its own merits. Given the factual background you present, it would appear that you have a very strong argument for exceptional circumstances and best interest of the child.
