Property Division - MD Divorce Law

My husband & I have talked about separating/divorcing. We just sold our house and will equally split the profits. I plan on buying my childhood home from my dad. The loan and deed will be entirely in my name. If he does move with me to the new house and things don't work out, how much of the house will I owe him?

You need to enter into a written agreement with your husband that he will claim no interest in the new house, and you will agree to be entirely responsible for the mortgage payments. Otherwise, if you start paying the mortgage from your earnings or from any other joint funds, he will be entitled to a marital interest. You should consult with an experienced family attorney who can prepare a proper agreement that will protect you down the road.
