Legal Question in Family Law in Maryland

My ex wife has physical and legal custody of 2 (age 13 and 11) of our 3 children. I have physical and legal custody of 1 of our children (age 8). When we went to court 2 years ago we were informed that we had to split all childchild and activity expenses. The children that my exwife has doesnt child care expenses and isnt any any activies. But the child that I have has been in child care for the last 2 years and has played multiple sports. My ex wife stated she wasnt and hasnt split any of these cost, but now she would like for me to give her 200 dollars a month for the children that she has custody for. Is this possible? Should I file for her being in contempt of court?

When you were in court 2 years ago, child support guideline worksheets should have been prepared which would have determined which parent had to pay support to the other. This is based upon a number of factors--respective incomes (before taxes), child care expenses, health insurance costs, and uninsured medical expenses. Generally such things as extracurricular activities aren't part of the calculation. However, a judge can adjust the guideline amount within a certain range if appropriate. If over the past 2 years there has been a significant change in income for either of you, there may be a basis for modification of the 2 year old order. If your ex is violating a specific court order to reimburse you for the expenses your 8 year old is incurring, then you would have the basis for seeking a contempt order. You should schedule a consultation with an experienced family attorney who can review your specific numbers re income, etc., and determine if there is a legal basis for adjusting the amount of support, or if your ex should be paying more toward your child's expenses.
