Legal Question in Civil Litigation in Maryland

Credit Card Theft/Fraud

I recently inadvertently left my credit card at a major car rental office, they called me a couple of hours later to advise they had located my card and were going to put it in the safe at the premises. It was placed in the safe, but later stolen by an employee (charged by police). The car rental company failed to call me and advise me of the card being taken from their safe. The employee racked up $1600 worth of charges. Once charged the car rental company failed to even contact me and apologise. Do I have any recourse against the car rental company?

Re: Credit Card Theft/Fraud

If you were wise enough to immediately notify your card provider so that they could void out the card, you shouldn't be held responsible for any unauthorized charges. Thus you have sustained no real damages (yes, some inconvenience, although you are at least partly responsible for this because you left your card behind). It appears that the car rental company acted reasonably in putting the card in a secure place, and they couldn't foresee an employee acting like a thief, assuming there was no prior history of this.
