Denied disability benefits

I was in a motorcycle accident in Feb '05. I purchased long term disability through my employer a couple of years ago (Colonial Life). The ''review board'' at Colonial has decided not to pay me any more disability benefits.

I returned to work Aug 8th, but no benefits for July. I have not been released by my doctor to return to work, but I see him on the 18th. I had only been able to walk unassisted for 2 weeks when I returned to work.

If I appeal and they pay the July benefits, but it takes them months to pay me, can they be liable for punitive damages?

The extent of coverage is contained in the binder for coverage as issued by the insurer. I would need to see the contract for coverage as well as all payments that were made by the company.

If you have not obtained representation for the motorcycle accident then you should consider doing so. You did not mention who was at fault for the vehicle collision.
